The prospect of making a personal injury claim can seem daunting at first. We get it – nobody ever wants to have to take legal action, particularly in the wake of what’s likely to have been a distressing and turbulent time for you and your family.
But here at Capital Lawyers, it’s our job to make the process as simple and stress-free as possible. Answering your questions is an important part of that. We’re often asked similar questions, so we thought it would be a good idea to answer the most frequently asked ones in a dedicated article.
Without further ado, here are the answers you’ve been looking for!
Is it too late for me to make a claim?
Generally speaking, you will have three years from the date of the incident or injury diagnosis to begin the process of making a claim. There are a number of exceptions to this rule, however – in some instances, you will have longer to start the claim process. If you’re in any doubt or the three year cut-off is fast approaching, we would advise getting in touch with us as soon as possible.
How much compensation might I be entitled to?
This is a difficult question to answer because there are so many variables to consider in every serious accident or personal injury case. These include the nature and severity of your injury, the lasting effect it has had on your ability to work, as well as any associated treatment costs you’ve incurred as a result.
When you get in touch with us to discuss your claim, we will be able to give you more of an idea. It’s essential that we understand the facts of your case before making any predictions about how much compensation you may be entitled to.
What does ‘no win, no fee’ really mean?
It means that if your claim is unsuccessful, you won’t have to pay us any legal fees. Although the vast majority of our cases (98%) are successful, it’s good to know that you won’t be out of pocket if things don’t go your way in the end.
Who will pay my compensation if my case is successful?
If you’re concerned about placing your employer in financial jeopardy by making a claim, don’t worry. Their Liability Insurance will cover the payout, so your employer won’t have to foot the bill. Likewise, if you’ve been involved in a serious road accident, the at-fault party’s insurance will pay any compensation you’re entitled to.
